About Peters Package
Peters Package (Pty) Ltd (Reg No: 2022/493085/07) operates a technology platform that connects individuals who need to send parcels with people already travelling in the same direction. Peters Package acts solely as an intermediary and does not itself transport, handle, or take possession of any parcels.

Acceptance of Terms
By registering an account or using the Peters Package platform, you confirm that you have read, understood, and agree to be bound by these Terms & Conditions in full. If you do not agree, you may not use the platform.
§3
Age Requirement
You must be at least 18 years old to use Peters Package. By creating an account, you confirm that you are of legal age and legally permitted to enter into binding agreements under South African law.

Account Registration & Identity Verification
Users are required to provide accurate personal information and verify their identity using a valid South African ID or passport. False identity information will result in immediate account termination. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.

Account Suspension & Termination
Peters Package reserves the right to suspend, restrict, investigate, or permanently terminate any account suspected of fraudulent activity, misuse of the platform, abusive conduct, false identity information, or any violation of these Terms & Conditions, with or without prior notice.

Platform Availability
While we strive to provide uninterrupted service, Peters Package does not guarantee continuous availability, error-free operation, or uninterrupted access at all times. Temporary outages, maintenance windows, or technical failures may occur without notice. Peters Package will not be liable for any loss arising from platform unavailability.

Prohibited Items
The following items may not be transported using Peters Package under any circumstances: illegal drugs or controlled substances, firearms or ammunition, explosives or flammable materials, biological or hazardous materials, live animals or human remains, stolen or counterfeit goods, large amounts of cash, and any item prohibited under South African law. Peters Package reserves the right to update this list at any time.

Parcel Value & Risk
Users send parcels entirely at their own risk. Peters Package does not insure parcels and accepts no liability for loss, damage, or theft. Users are strongly advised not to send high-value items such as jewellery, large sums of cash, rare collectibles, or irreplaceable personal items through the platform.

Delivery Confirmation
Delivery is considered complete once confirmed through one or more of the following: OTP/PIN verification, recipient acknowledgement via the platform, digital signature, GPS confirmation, delivery photograph, or recipient communication through the Peters Package chat system.

Proof of Delivery
Proof of delivery may include photographs, digital signatures, OTP codes, GPS data, or recipient messages recorded on the platform. Electronic proof of delivery constitutes sufficient legal evidence of completion under these Terms.

Cancellation Policy
Senders may cancel a parcel request at any time before it is collected by the driver. Once collected, the delivery fee is non-refundable and a cancellation charge may apply. Disputes arising from cancellations must be submitted within 48 hours.

Dispute Resolution
Parties must first attempt to resolve disputes directly and in good faith through the in-app chat. Unresolved complaints must be submitted to Peters Package at support@peterspackage.com within 48 hours of the delivery date. Peters Package may investigate disputes at its sole discretion but is not obligated to provide compensation. Peters Package's decision on disputes is final.
§13
Limitation of Liability
To the maximum extent permitted by South African law, Peters Package's total liability to any user for any claim shall not exceed the transaction value of the specific delivery in dispute. Peters Package shall not be liable for indirect, consequential, special, or punitive losses, delays, damages, theft, failed deliveries, or disputes arising between users.

Amendments to Terms
Peters Package reserves the right to update or amend these Terms & Conditions at any time. Users will be notified of material changes via email or in-app notification. Continued use of the platform after any amendment constitutes acceptance of the updated terms.
§15
Governing Law & Jurisdiction
These Terms & Conditions are governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes shall be subject to the exclusive jurisdiction of the South African courts. Nothing in these Terms excludes or limits any rights users may have under the Consumer Protection Act (CPA) or POPIA.

POPIA Compliance
Peters Package complies with the Protection of Personal Information Act (POPIA) of South Africa. By registering, you consent to the lawful collection, storage, and processing of your personal information for the purposes of operating the platform.

How We Use Your Information
Your information is used solely to verify your identity, facilitate deliveries, process payments, communicate with you about your account, and comply with legal obligations. We do not sell or share your personal information with third parties for marketing purposes.

Data Retention
Personal information is retained for as long as your account is active and for a minimum of 5 years after account closure to comply with South African financial and legal record-keeping requirements. Identity documents are stored securely in encrypted, private storage and are not publicly accessible.

Third-Party Services
Peters Package uses trusted third-party services to operate the platform, including Supabase (data storage), PayFast (payment processing), and Resend (email notifications). These providers operate under their own privacy policies and are contractually required to handle your data securely.

Your Rights Under POPIA
You have the right to access your personal information, request corrections, object to processing, and request deletion of your data subject to legal retention requirements. To exercise these rights, contact us at support@peterspackage.com. Requests will be processed within 30 days.
§22
Security
We implement industry-standard security measures including encryption, hashed identity numbers, private document storage, and row-level access controls to protect your personal information. However, no system is entirely secure and we cannot guarantee absolute data security.
§23
Driver Status
By registering as a driver on Peters Package, you acknowledge and agree that you operate as an independent contractor and not as an employee, agent, or partner of Peters Package. Peters Package does not control how, when, or where you make deliveries.

Driver Responsibilities
As a driver you are solely responsible for:
- Holding a valid South African driver's licence for the vehicle used.
- Maintaining valid motor vehicle insurance and a roadworthy vehicle.
- Complying with all applicable South African road traffic laws.
- Accepting full responsibility for parcels in your possession during transport.
- Handling all parcels with reasonable care and delivering them in the same condition received.
- Collecting and delivering parcels only to the agreed parties verified by the platform PIN system.
§25
Driver Earnings & Payouts
Driver earnings are the agreed delivery fee minus Peters Package's platform commission and applicable payment processing fees. Payouts are processed within 7 business days of confirmed delivery. Peters Package reserves the right to withhold payment in cases of dispute, fraud, or suspected misconduct pending investigation.

Driver Ratings
Senders may rate drivers after delivery is confirmed. Ratings are visible to other platform users. Peters Package reserves the right to remove drivers with consistently low ratings or negative feedback at its sole discretion.
§27
Sender Responsibilities
By posting a parcel request, you confirm that:
- All parcel descriptions and declared values are accurate and truthful.
- The parcel contains no prohibited, illegal, or hazardous items.
- You have the legal right to send the parcel and its contents.
- The parcel is adequately packaged to withstand normal handling during transit.
- You will be available to coordinate collection and delivery with the driver.

Parcel Posting & Pricing
Senders set their own offered delivery price. Drivers may accept, counter-offer, or decline any request. Peters Package does not set or regulate delivery prices between users. Payment is processed securely through PayFast before the driver collects the parcel.

Sender Ratings & Responsibility
Senders who provide inaccurate parcel information, send prohibited items, or act in bad faith may have their accounts suspended or terminated. Peters Package reserves the right to hold senders liable for losses incurred by drivers or third parties as a result of false or misleading parcel information.

Payment Processing
All payments on Peters Package are processed securely by PayFast, a registered South African payment service provider. Peters Package does not store card numbers or banking details. By making a payment, you also agree to PayFast's terms of service.

Platform Fees
Peters Package charges the following fees on each completed transaction:

Final payout amounts may vary slightly based on transaction processing costs. Fees may be updated from time to time with notice to users.
§32
Refunds
Payments are non-refundable once a driver has collected the parcel. Refund requests for uncollected parcels must be submitted within 24 hours to support@peterspackage.com. Approved refunds will be processed within 7 business days via the original payment method.
§33
Driver Payout Timeline
Driver earnings will be paid out within 7 business days of confirmed delivery via PayFast to the driver's registered bank account or e-wallet. Peters Package is not responsible for delays caused by the payment provider or incorrect banking details provided by the driver.

Fee Amendments
Peters Package reserves the right to update platform fees at any time. Users will be notified via email or in-app notification at least 14 days before any fee increase takes effect.
